Product liability lawsuits can be very expensive to defend, but the damage ultimately can have huge economic implications to a client. Phenix was called on to assist a litigation team to defend a transportation client who was being sued for wrongful death damages. The prosecution claimed that the defendant's company was liable for the death of a person who was a passenger in their transportation aircraft. The damages sought were nearly $500 million. Phenix's role was to locate witnesses, conduct detailed interviews, recover safety and compliance records, retrieve visuals, and interview expert witnesses in the air transportation field.
The combined efforts of the investigators and the litigation team uncovered significant evidence to dispute the prosecution's allegations. In the end, the judge ruled for the defense and the defendant's company averted millions of dollars in wrongful death damages. While the defense for this case was quite expensive, it paid off with a victory in the courtroom.
